THE SERVICE

The eRobertParker.com Web site provides access to wine tasting notes and other information about wine previously published by Robert M. Parker, Jr. in his newsletter, The Wine Advocate, and in his various books. It may also include other features and services of interest to wine drinkers and collectors and to those in the wine trade. The choice of such features and services is entirely up to eRobertParker.com. The specific features and services provided may change from time-to-time without notice.

The database of information will be updated approximately every 60 days. Information derived from The Wine Advocate will be posted approximately 30 days after each issue of the newsletter is mailed.

YOUR SUBSCRIPTION

Your subscription provides unlimited access to this information via the Internet from one or more personal computers. You may not access the information from more than one computer at any given time.

You must select a Personal ID and Password at the time you subscribe (subject to the availability of the Personal ID and Password you choose). We will use certain technologies to ensure that only one person is using each Personal ID at any given time. Sharing your Personal ID and Password with others (except as described below) is a violation of this agreement, may make it impossible for you to use the service when another person or entity is using your Personal ID and is grounds for immediate termination of your subscription (without a full or partial refund of your subscription fee).

WHO MAY USE YOUR SUBSCRIPTION

If you are an individual your subscription is for your own personal use of the service. It may not be shared, resold, subdivided or sublicensed to anyone else (except for immediate family members defined as your spouse and any relatives living with you in your primary residence).

If you are an entity engaged in the wine trade, such as a retail wine shop, wine importer, wine wholesaler or restaurant, use of your subscription is limited to your employees during normal business hours and from a single personal computer located at your place of business.

Except as described above, your subscription is not transferable to, or usable by, another person, business or other entity without our consent.

We will use certain technologies to monitor your use of our service to be certain it is in compliance with the terms of this agreement. Intentional use of the service in a manner inconsistent with this agreement will be grounds for termination of your subscription. No full or partial refunds will be offered for subscriptions terminated for intentional use of the service not in compliance with this agreement.

Access to the service using special computer programs (Web Robots, Web Wanderers, Crawlers, or Spiders) designed to systematically download the information in the database is strictly prohibited. We will use certain technologies to detect the use of these programs. Their use is a violation of this agreement and is grounds for immediate termination of your subscription (without a full or partial refund of your subscription fee).

TERM OF YOUR SUBSCRIPTION

Your subscription is for the term agreed to at the time you registered for our service. We will attempt to notify you, using the personal information you provided to us, approximately 14 days before your subscription is due to expire. Your subscription will be automatically renewed unless you turn automatic renewal off by visiting the online Support page and changing your account information.

CONTROL OF YOUR PERSONAL INFORMATION

We may occasionally allow other companies to provide information to our subscribers about their wine-related products or services. We will never provide any information to these companies other than your email address. We will only do that if you specifically agree to it at the time you register.

SECURITY OF YOUR PERSONAL INFORMATION

eRobertParker.com strictly protects the security of your personal information and honors your choices for its intended use. We carefully protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

Your personal information is never shared outside the company without your permission, except under conditions explained above. Inside the company, data is stored in password-controlled servers with limited access. Your information will be stored and processed in the United States.

You also have a significant role in protecting your information. No one can see or edit your personal information without knowing your ID and password, so do not share these with others.

The information provided by eRobertParker.com is the copyrighted property of Robert M. Parker, Jr. and/or The Wine Advocate. Your use of this information is limited to you alone under the terms of this agreement. It may not be copied, retransmitted, sold or provided to others in any form or format except as provided for in this section of the Subscription Agreement.

The news media and subscribing wine distributors and retailers may use brief portions of this material provided it is not distorted, the correct wine and vintage are stated, eRobertParker.com is given credit for the material utilized, and The Wine Advocate is shown as the Copyright holder.

USE OF COOKIES

When you sign onto our Web site it assigns a personal identification number and sends it to your computer in the form of a small text file, called a "cookie." This cookie allows us to monitor your use of our site. This is done only for the purpose of protecting us, and you, should your ID and Password become available to someone other than you. For more details refer to the eRobertParker.com subscription agreement.

We do not track individuals' use of the site.

If you choose to not have your browser accept cookies from the eRobertParker.com Web site, you will not be able to sign on.

LIMITATION OF LIABILITY

eRobertParker.com will use reasonable efforts to assure the accuracy, responsiveness and availability of the service to its subscribers. Under no circumstance will we be liable for any direct or indirect damages with respect to the accuracy of the information, the availability of the service, the responsiveness of the service or your use of information provided to you by the service.

The "Find it Online" feature of this Web site is provided through an arrangement with WineAlert. Neither eRobertParker.com nor WineAlert has any commercial relationship with any of the wine retailers listed. We receive no commissions or commercial consideration for including these retailers in the service or for referring you to their Web sites.

Although it has been professionally edited, neither eRobertParker.com nor WineAlert can guarantee the accuracy of the wine retailer information. You should use reasonable caution in making any purchase arrangement with the wine retailers listed, including whatever is necessary to assure that your purchase is legal in the jurisdictions in which you and the wine retailer are located.

The purchase, sale and distribution of wines is regulated by different laws in various jurisdictions. Both the purchaser and seller should make certain that they are familiar with the current laws governing the sale and shipment of wines in their jurisdictions.

COMPLETE AGREEMENT

This is the complete agreement with respect to your use of the eRobertParker.com Web site. Nothing published or said elsewhere should be viewed as a modification of this agreement.

CHANGES TO THIS AGREEMENT

eRobertParker.com may occasionally update this agreement. When we do, we will also revise the "last updated" date at the top of the copy of the agreement posted on this Web site. For material changes to this agreement, eRobertParker.com will notify you by placing a prominent notice on the Web site.

Such changes will be effective when posted by us. Your continued use of the service after the date upon which this agreement is changed and the changes are posted will constitute your continued acceptance of this agreement. Your only alternative, should you no longer wish to be bound by this agreement, is termination of your use of the service. No full or partial refunds will be offered in such an event.
